Georgia Divorce Laws: Grounds & Process
Georgia law recognizes 13 grounds for divorce. These include fault-based grounds and no-fault, which is the most commonly used. Fault-based grounds, such as for adultery, desertion, or cruel treatment, must be proven in court, involving time, money, and stress.
No-fault divorce is based on the irretrievable breakdown of the marriage and does not require court hearings to establish misconduct. When couples agree on the divorce terms, it is typically faster, more cost-effective, and less stressful.
Once a petition is filed, divorcing couples must resolve several key issues:
- Marital property and debt division
- Alimony
- Child custody and visitation
- Child support
Property Division in Georgia
Georgia is an “equitable division” state, meaning that any marital property must be divided fairly, which does not necessarily mean “equally.” Many factors are considered in determining this.
Clients, especially those with significant assets, need confidence that their attorney knows how to find the assets, value them, and effectively argue for a fair distribution based on the facts and circumstances of their unique situation.
Our team has the skill and knowledge honed over decades of practice to uncover the marital estate's actual composition and value through our mastery of the information-seeking, or “discovery,” process inherent in divorce litigation.
