Georgia law draws a sharp line between the two proceedings. Paternity identifies a man as the biological father of a child and creates a financial support obligation. Legitimation goes further: it establishes the legal parent-child relationship. Under Georgia law, a child born out of wedlock is solely under the custody of the mother. Even a father listed on the birth certificate has no legal parental rights absent a formal legitimation order. Signing the birth certificate, living with the child, or paying child support voluntarily doesn’t legitimate a child under Georgia law. Establishing Paternity in Georgia

Georgia law provides three ways to establish paternity. Each creates a financial support obligation for the father, but none automatically grants parental rights to custody or visitation. For an unmarried father who wants those rights, legitimation remains a required separate step.

The three methods under Georgia law:

  1. The parents are legally married to each other at the time of the child’s birth.
  2. Unwed parents sign a Voluntary Paternity Acknowledgment form at the hospital, at the State Office of Vital Records in Atlanta, or at the Vital Records Office in the county where the child was born. This form becomes legally binding after 60 days, after which it may only be challenged in court on grounds of fraud, duress, or material mistake of fact under O.C.G.A. § 19-7-46.1.
  3. Through a court order, including in a paternity action or as part of a divorce or separation proceeding.

Either parent, a relative caring for the child, the child through a guardian, or the Georgia Division of Child Support Services may file a petition to establish paternity if it hasn’t been voluntarily acknowledged. If paternity is disputed, a court may order genetic DNA testing to determine biological fatherhood.
